2. Scope and legal framework

This policy applies to personal information handled through this website and to enquiries initiated through the website’s email link. It is designed primarily around Australian privacy requirements, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) to the extent they apply to LSEA Inc. and the relevant activity.

This website may be accessed from outside Australia. Where a privacy or data-protection law in another jurisdiction legally applies to LSEA Inc.’s processing, we will handle personal information in accordance with the additional requirements that apply in that context. Merely making this Australian website accessible worldwide does not, by itself, mean every overseas privacy law applies to LSEA Inc.

This policy is limited to the current website and website-originated enquiries. Participant, program, volunteer, employment, membership, donation or other offline records may require separate privacy notices, consent processes or information-handling procedures.

4. How we collect information

We primarily collect website-related personal information directly from you when you email us. Technical information may also be generated automatically by the website hosting, security or server infrastructure when the website is accessed.

Where it is lawful and practicable, you may contact us without identifying yourself or by using a pseudonym. We may need sufficient information to respond to a particular request, verify identity for an access or correction request, or comply with legal obligations.

5. Sensitive information, children and young people

LSEA Inc. works in areas that may involve young people and vulnerable individuals. This splash website is not intended to collect participant case information, health information, trauma histories, criminal records or other sensitive information through an online form.

Please do not send sensitive personal information by ordinary email unless it is necessary and appropriate to do so, or LSEA Inc. has specifically requested it. If we receive unsolicited sensitive information, we will consider whether it is lawful and necessary to retain it and may delete or de-identify it where appropriate.

If you are under 18, consider asking a parent, guardian or trusted support person to assist you before sending detailed or sensitive personal information by email.

At the date of this policy, this splash website does not use advertising cookies, behavioural tracking, third-party analytics or marketing pixels. It does not profile visitors and does not use automated decision-making to make decisions about individuals.

Technical server logs used for security, availability and troubleshooting are not the same as behavioural advertising or marketing analytics. If LSEA Inc. later introduces analytics, cookies, online forms, automated decision-making or similar functionality, this policy and any required notices or consent mechanisms will be updated before or when those changes are introduced.

9. When we may disclose personal information

We may disclose personal information where reasonably necessary to service providers that support our email, website hosting, information technology, security, professional advice or administration, and to regulators, authorities or other parties where required or authorised by law. We may also disclose information with your consent or where you ask us to do so.

LSEA Inc. does not sell or rent personal information collected through this website.

10. Email providers and overseas processing

The email link in the website footer sends email to an LSEA Inc. email address. Your own email provider and our email, hosting or technology service providers may process or store information in Australia and/or overseas as part of globally distributed infrastructure.

The countries involved may vary according to the provider, service configuration, network routing and the location of the sender, and it may not be practicable to specify every country in advance. Where Australian cross-border privacy requirements or other applicable international transfer rules apply, LSEA Inc. will take the steps required in the circumstances before making a regulated overseas disclosure or transfer.

11. Security

We take reasonable steps appropriate to the circumstances to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure. Measures may include access controls, account security, secure hosting practices, software and security updates, and limiting access to people who reasonably need the information.

No internet transmission, email service or information system can be guaranteed to be completely secure. You should avoid sending unnecessary sensitive information by ordinary email.

12. Retention and deletion

We retain personal information only for as long as it is reasonably needed for the purpose for which it was collected, for legitimate organisational needs, or to meet applicable legal, governance, insurance or record-keeping requirements. When information is no longer required, we will take reasonable steps to delete or de-identify it where appropriate and permitted by law.

Technical server-log retention may also depend on the settings and retention practices of our hosting or infrastructure providers.

We will acknowledge and investigate privacy complaints and aim to respond within 30 days. If we need more time, we will let you know where reasonably practicable.

If the Australian Privacy Act applies to the matter and you are not satisfied with our response, you may be able to complain to the Office of the Australian Information Commissioner (OAIC). If an overseas privacy law applies, you may also have a right to complain to the relevant privacy or data-protection regulator in your jurisdiction.

If a data breach occurs, we will assess and respond to it in accordance with applicable legal requirements. Where the Australian Notifiable Data Breaches scheme or another applicable breach-notification law requires notification, we will notify affected individuals and/or the relevant regulator as required.
